Elaine M. Ross focuses her practice on defense of high-exposure medical malpractice cases in Philadelphia, Chester, Montgomery and Lancaster Counties in Pennsylvania. She has thirty plus years of litigation experience in the defense of hospitals, nurses, physicians and other acute care medical providers, with extensive successful experience in jury trials and pretrial settlement negotiations. Elaine also has experience in insurance coverage, long term care defense and general liability defense cases as well as more than 15 years of criminal defense experience as Court Appointed Counsel by the City of Philadelphia in major felony cases.
Elaine has been involved in numerous high-exposure cases ($1 million or higher) where the defense has involved retention of numerous sophisticated experts, especially in claims involving brain-injured infants. A number of those cases have proceeded to jury verdict, with defense verdicts being the result in the great majority of cases. Elaine has started more than 100 jury trials in her career, and she has tried approximately 50 cases to verdict, including approximately 45 verdicts in the field of medical professional liability defense. She has secured defense verdicts in approximately 95 percent of the cases she has tried to verdict.
Throughout her career, Elaine has represented hospitals and physicians in Philadelphia and surrounding suburban counties, as well as Lancaster, York, Cumberland and Berks Counties. She is most often involved in cases where multiple experts are retained (as many as eight to 10) on behalf of her clients, who deal with issues of standard of care, causation, relationship of other medical conditions to the injury in question, life expectancy, damage claims, economic losses, etc. Through the use of often complicated coordination of such experts, Elaine has secured either settlements or verdicts that are far below the damage claims sought by the plaintiffs.
As an active member of her community, Elaine serves as Vice President for Wyngate HOA in Montgomery County, Pennsylvania and participates in canine rescue operations for various animal rescue groups. A 1981 graduate of Temple University, Elaine received her Bachelor of Business Administration in Economics. Thereafter, while she was employed as a Banking Structure Analyst and Economic Research Assistant at the Federal Reserve Bank of Philadelphia, she attended law school at Widener University as an evening student, graduating in 1986.
