Derek M. Daniels is a founding partner of McCumber Daniels and practices from the firm’s Florida and Pennsylvania offices. He is board certified by the Florida Bar in civil trial law. Mr. Daniels obtained his Bachelor of Science degree in Business Administration with High Honors in 1992 from the University of Florida. He earned his Juris Doctor degree with Honors from the University of Florida in 1995. He has been admitted to practice law in Florida since 1995. In 2006, Mr. Daniels passed the Pennsylvania and New Jersey Bar examinations and has been admitted to practice law in both of those states since that time.
Since 1998, Mr. Daniels’ practice has focused on the areas of medical malpractice, hospital, and nursing home defense litigation. Mr. Daniels has successfully defended health care providers in a broad spectrum of cases from minor injuries to infant wrongful death. He also focuses his practice in the area of general liability defense with a particular emphasis on catastrophic loss cases. These types of matters involve allegations such as child abandonment, sexual abuse, restraint deaths, suicide, and homicide. Mr. Daniels also has significant experience defending corporate structures in cases involving attempts to pierce the corporate veil or direct claims against parent companies. He has worked with numerous clients in developing and modifying corporate structures of organizations to optimize liability protection.
Mr. Daniels is an active member of the Florida Hospital Association and Florida Society for Healthcare Risk Management and Patient Safety. He has presented numerous times at various industry conferences and continuing legal education seminars on a variety of topics such as mock trials, apex official depositions, Amendment 7 discovery, and most recently on the new challenge faced by hospitals with the advent of medical negligence claims based on non-delegable duties. Additionally, Mr. Daniels serves as Counsel Co-Chair on the Medical Claims Committee for the Professional Liability Defense Federation. In 2006, he was recognized by his peers as a “Legal Elite” as profiled in Florida Trend Magazine. In 2011, he was named a Super Lawyer Rising Star.
